1. Agreement to Terms

By accessing or using HeroKids ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

HeroKids is operated in the United Kingdom and these Terms are governed by UK law.

2. Service Description

HeroKids provides an AI-powered portrait generation service that:

• Transforms uploaded photos into superhero and fantasy character portraits
• Generates instant previews (~60-90 seconds)
• Allows unlimited regenerations before purchase
• Delivers high-resolution images via email after payment

3. User Eligibility and Consent

3.1 Age Requirement

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age.

3.2 Parental Consent

By uploading a photo of a child, you confirm that:

• You are the parent or legal guardian of the child
• You have the right to consent to the processing of the child's image
• You consent to the child's photo being processed by our AI system
• You understand the photo will be deleted within 30 days

4. Acceptable Use

4.1 Permitted Use

You may use the Service to:

• Create personal portraits for private, non-commercial use
• Generate portraits of your own children or children you have permission for
• Download and print portraits for personal enjoyment

4.2 Prohibited Use

You must NOT:

• Upload photos of individuals without their (or their guardian's) permission
• Upload photos containing nudity, violence, or inappropriate content
• Use the Service for commercial purposes without written permission
• Reverse engineer, copy, or replicate our AI technology
• Attempt to access systems or data you're not authorized to access
• Upload malware, viruses, or harmful code
• Abuse, harass, or harm others through the Service
• Violate any applicable laws or regulations

Violation of these terms may result in immediate termination of your access to the Service and deletion of your data.

5. Pricing and Payment

5.1 Current Pricing (MVP)

Our current pricing is:

• Single Hero: £7.99 - 1 template, 1 high-resolution portrait (selected from 3 preview variations)

Additional pricing tiers (Hero Pack, Ultimate Hero) will be available in future updates.

5.2 Payment Processing

• All payments are processed securely via Stripe
• Prices are in British Pounds (GBP) and include VAT where applicable
• Payment is required before downloading high-resolution images
• You can preview and regenerate unlimited times before payment

5.3 No Hidden Fees

We believe in honest pricing. The price you see is the price you pay. No fake discounts, no countdown timers, no hidden fees.

6. Instant Preview and Generation

6.1 Preview Generation

• Preview generation typically takes 60-90 seconds
• 3 variations are generated simultaneously
• You can regenerate unlimited times at no cost
• Payment is only required when you're satisfied with a preview

6.2 Final Image Generation

• After payment, we generate a high-resolution version of your selected variation
• Final images use the exact seed from the preview you selected
• Images are delivered via email within 5 minutes
• Download links are valid for 7 days

6.3 No Guarantees

While we strive for high-quality results, AI-generated images are inherently unpredictable. We do not guarantee:

• Perfect likeness to the uploaded photo
• Specific artistic style or composition
• That every generation will meet your expectations (that's why we offer unlimited free previews)

7. Refunds and Cancellations

7.1 Our Refund Policy

We want you to be happy with your portraits. If you're not satisfied:

• Contact us at support@herokids.co.uk within 24 hours of purchase
• Explain why you're dissatisfied
• We'll review your request and may offer a full refund at our discretion

7.2 No Refunds After 24 Hours

Due to the digital nature of our product and instant delivery, we cannot offer refunds after 24 hours from purchase.

7.3 Prevention Over Cure

To minimize dissatisfaction, we encourage you to:

• Use the free preview to see results before paying
• Regenerate as many times as needed (unlimited and free)
• Only proceed to payment when you love a preview variation

8. Intellectual Property and Ownership

8.1 Your Photos

You retain all rights to the photos you upload. We do not claim ownership of your photos.

8.2 Generated Portraits

Once you pay for a portrait:

• You receive a personal, non-exclusive, non-transferable license to use the portrait
• You may print, display, and share the portrait for personal, non-commercial use
• You may NOT resell, redistribute, or use the portrait commercially without written permission
• We retain the copyright to the generated artwork

8.3 Our Service

All aspects of the Service, including but not limited to:

• AI models and technology
• Website design and code
• Template designs
• Brand and logo

...are owned by HeroKids and protected by UK and international copyright, trademark, and intellectual property laws.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Key points:

• Uploaded photos are deleted after 30 days
• Photos are NEVER used to train AI models
• Photos are NEVER shared with third parties
• All data is stored securely with encryption

10. Service Availability

10.1 No Guarantee of Availability

We strive to keep the Service available 24/7, but we do not guarantee:

• Uninterrupted access to the Service
• Error-free operation
• Specific generation times (though we target 60-90 seconds)

10.2 Maintenance

We may perform scheduled or emergency maintenance that temporarily suspends access to the Service. We'll provide advance notice when possible.

10.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We'll provide reasonable notice for significant changes.

11. Limitation of Liability

To the maximum extent permitted by UK law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid for the Service (£7.99 for Single Hero)
• We are not responsible for loss of data, profits, or business opportunities

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by UK law.

12. Indemnification

You agree to indemnify and hold harmless HeroKids from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your violation of any third-party rights (e.g., uploading photos without permission)
• Your misuse of the Service

13. Termination

13.1 Termination by Us

We may terminate or suspend your access to the Service immediately, without notice, if:

• You violate these Terms
• You upload inappropriate or illegal content
• We reasonably believe you're abusing the Service

13.2 Effect of Termination

Upon termination:

• Your access to the Service ends immediately
• Uploaded photos may be deleted immediately
• You lose access to any pending previews
• Paid portraits remain accessible via download links (if not expired)

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by the laws of England and Wales.

14.2 Dispute Resolution

If you have a dispute with us, please contact us at support@herokids.co.uk first. We'll do our best to resolve it amicably.

14.3 Jurisdiction

Any legal proceedings must be brought in the courts of England and Wales.

15. Changes to These Terms

We may update these Terms from time to time. When we make significant changes:

• We'll update the "Last updated" date at the top
• We'll notify you by email if you're a customer
• We'll display a prominent notice on our website
• Your continued use of the Service after changes constitutes acceptance

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HeroKids regarding the Service.
